Abstract
Trademark protection and intellectual property rights over logos have become increasingly relevant in the midst of intense business competition. This study analyzes the fundamental similarity between the Pecel Lele Lela logo and the Starbucks logo, which once triggered a formal protest from Starbucks in 2011. The research aims to determine whether the elements of fundamental similarity between the two logos are fulfilled under Indonesian positive law. The method employed is a normative juridical approach using secondary data consisting of primary, secondary, and tertiary legal materials, analyzed through descriptive qualitative analysis. The results indicate that legal protection for both logos encompasses copyright aspects under Article 1 paragraph (1), Article 5, Article 8, Article 9, Article 40 paragraph (1), Article 59, Article 65, Article 113 paragraph (3), and Article 114 of Law Number 28 of 2014 on Copyright (UUHC), as well as trademark aspects under Article 1 paragraph (1), Article 21 paragraph (1) letter b, Article 21 paragraph (3), and Article 100 paragraph (2) of Law Number 20 of 2016 on Trademarks and Geographical Indications (UUMIG). Analysis of the five elements of fundamental similarity, namely form, dominant color, element placement, writing style, element combination, and phonetic similarity, reveals that none of the elements is substantially fulfilled. Features perceived as similar, such as the circular shape and the dominant green color, constitute common design elements that cannot be claimed exclusively by any single party. The dispute was resolved amicably out of court, with Pecel Lele Lela agreeing to redesign its logo as an act of good faith.
