Abstract

Divorce among adoptive parents may create vulnerability to an adopted child's right to care, while Central Statistics Agency data show around 900 divorces per year in Surakarta City. This study aims to describe and analyze the roles of the Office of Women's Empowerment, Child Protection, Population Control, and Family Planning (DP3AP2KB), the Social Service Office, and the Religious Court in guaranteeing the right to care of adopted children affected by their adoptive parents' divorce in Surakarta City, and to analyze the efforts of the three institutions in overcoming obstacles to the implementation of their roles. This study uses an empirical juridical method with a descriptive qualitative design. Primary data were obtained through semi-structured interviews with three purposively selected informants representing DP3AP2KB, the Social Service Office, and the Surakarta Religious Court, while secondary data were obtained through literature review, analyzed descriptively and qualitatively using role theory as the analytical tool. The results answer the roles of DP3AP2KB, the Social Service Office, and the Religious Court reflect coordinated institutional readiness, both preventive and repressive, grounded in Law Number 35 of 2014 on Child Protection DP3AP2KB and the Social Service Office act preventively through education, eligibility assessment, and monitoring, while the Religious Court acts repressively in a positive sense through the principle of equal status for adopted children and the judge's ex officio authority. Obstacles to role implementation low public legal awareness, administrative barriers to legal aid access, social stigma, and disparities in enforcing child support obligations are addressed through advocacy, mediation, and outreach that are preventive and coordinative, and require stronger, more comprehensive formal institutional cooperation to be implemented more optimally
