Abstract

Criminal cases can be handled in two ways: through the court system or outside of it. Handling cases outside the court system can be achieved through Restorative Justice, an approach that focuses on repairing relationships and restoring the situation to achieve substantive justice, rather than merely punishing the offender. As a police agency in Indonesia, the Surakarta City Police (Polresta Surakarta) has begun implementing Restorative justice to handle criminal cases within its jurisdiction. This study aims to examine how criminal cases were resolved at Polresta Surakarta using the restorative justice approach between 2021 and 2023—in accordance with Indonesian National Police Regulation Number 08 of 2021—and to analyze the legal effectiveness of this approach. The study employs an empirical-juridical research method with a qualitative approach. Data were gathered through in-depth interviews with Polresta Surakarta investigators, direct observation, and a literature review. Data analysis involved data reduction, data presentation, and verification followed by drawing conclusions. The results indicate a significant increase in the resolution of criminal cases via restorative justice at Polresta Surakarta from 2021 to 2023, with the most frequent cases involving fraud, assault, and simple theft. The implementation of restorative justice is considered effective in achieving substantive justice by repairing the relationship between the offender and the victim and increasing victim satisfaction. However, challenges remain, such as varying public perceptions regarding the concept of justice and obstacles encountered during the mediation process.
