Abstract

The evolution of information technology encourages the rapid use of e-commerce, but it also raises problems related to the protection of consumers' personal data. The case of data leak on the Tokopedia platform shows that there is a gap between legal regulation and its implementation, thus casting doubt on the effectiveness of legal protection in electronic agreements. This study aims to analyze the form of violations in the practice of electronic agreements on Tokopedia and examine the legal protection of consumer personal data based on the Electronic Information and Transaction Law (ITE Law) and the Personal Data Protection Law (PDP Law). The method used is normative legal research with a statutory and descriptive approach, using secondary data that is analyzed qualitatively. The results of the study show that violations include illegal access to personal data, failure to protect and secure electronic systems, as well as leakage and dissemination of personal data, which are not only caused by external parties but also internal weaknesses of electronic system operators. Legal protection is carried out preventively through the obligation of the system provider to ensure data security, as well as repressively through administrative and criminal sanctions and the right to compensation for victims. However, its implementation is not optimal due to evidentiary constraints, limited cross-border tracing of perpetrators, and law enforcement that is still reactive, so the effectiveness of personal data protection is highly dependent on implementation and synergy between parties.
