Abstract

This study is motivated by the increasing prevalence of illegal levies (pungli) by unauthorized parking attendants in Surakarta City, which has risen alongside the rapid growth in the number of motorized vehicles. This phenomenon causes losses to parking service users, disrupts trafic order, and reduces the Regional Original Revenue (PAD) from official parking retribution. The objectives of this research are; to determine the practice of illegal levies by unauthorized parking attendants in Surakarta City Regional Regulation Number 10 of 2022 concerning Transportation Implementation in addressing these illegal levies; and to examine the prespective of Islamic Law on the practice approach with a descrriptive-qualitative research type. Primary data were obtained through interviews, observation, and library research at the Transportation Agency (Dishub), Satpol PP, Surakarta City Police (Polresta), and unauthorized parking attendants, while secondary data were sourced from laws and regulation, literature, and related documents. The results show that thepractice of illegal levies still occurs in a structured manner with territorial divison and an informal deposit system; the enforcement of Regional Regulation Number 10 of 2022 has been carried out preventive effots (socialization and guidanceI and repressive measures (joing operations), but it is not yet optimal duet o limited resources and the comunitiy’s legal culture; and from the prespective of Islamic of islamic Law, teh practice contradicts the principles of the wadi’ah bil ujrah contract because it contains elements of gharar, lack of trustworthiness (amanah), and insjustice.
