Abstract
Human trafficking is a form of modern crime that violates human rights and continues to increase in Indonesia. This crime is carried out in an organized manner to exploit victims for the benefit of certain parties. This study aims to compare the provision of restitution to victims in three final court decisions and to assess their conformity with Law Number 21 of 2007. The research uses a normative legal method with a case approach, based on an analysis of Decision Numbers 43/Pid.Sus/2018/PN Soe, 80/Pid.Sus/2020/PN Olm, and 782/Pid.Sus/2020/PN Mtr. The results show that two out of the three decisions namely 80/Pid.Sus/2020/PN Olm and 782/Pid.Sus/2020/PN Mtr are in accordance with the legal provisions on restitution, particularly regarding the amount of restitution, the judge’s considerations, and the seizure and auction of the perpetrator’s assets
