Abstract

Copyright infringement of unauthorized use of product photos for commercial purposes is widely complained by sellers on the Shopee Application. This study was conducted with the aim of finding out about the Shopee application policy regarding copyright infringement of product photos used for commercial purposes and to determine the suitability between Shopee's policy regarding copyright infringement of product photos with the provisions in Indonesia. The method used in this study is the normative legal approach method with secondary data consisting of primary legal materials such as laws and regulations and secondary legal materials in the form of related books and journals and using qualitative data analysis methods that are descriptive analytical. The results of the study indicate that Shopee's policy has regulated the issue of copyright infringement of unauthorized use of product photos by issuing a policy in the Seller Education Center which can be accessed independently by sellers, in addition Shopee also provides complaint services and sanctions against perpetrators of copyright infringement through the Shopee Brand IP Portal. Reviewed through Article 24 Paragraph (2) of Government Regulation Number 71 of 2019 concerning Electronic System and Transaction Organizers which stipulates the need for a prevention system for activities that cause losses, the Shopee system has not been able to prevent and detect early copyright infringement for the use of product photos without permission for commercial purposes.
