Abstract

The village is the lowest and smallest unit of government in Indonesia and has its own autonomy to regulate the interests of the village community and has its territorial boundaries. Regarding the management of village treasury land leases, it is regulated in Permendagri Number 1 of 2016 concerning village asset management and in Klaten Regency which is regulated by Klaten Regent Regulation Number 56 of 2020 concerning Village Asset Management. This research discusses the implementation of village treasury land leases in accordance with laws and regulations, obstacles to the implementation of village treasury land lease agreements, and lease agreements reviewed from Islamic Law. This research is based on legal research with an empirical juridical approach. In writing this research the author uses primary and secondary data types. The data collection method uses observation, interviews, and literature study. The data that has been processed will be analyzed qualitatively, based on deductive logic. Based on the results of the research, it shows that the practice of leasing village treasury land in Butuhan Village, Jetis Village, and Karang Village is in accordance with the laws and regulations and the Civil Code. The auction system used is open auction and closed auction. There are still obstacles in the process of implementing the lease of village treasury land, namely juridical obstacles and non juridical obstacles. For leases made by the village treasury land auction committee to the tenants, everything has been properly administered and an agreement letter is made. In terms of Islamic Law, lease/ijarah is allowed by fulfilling the pillars and conditions that have been determined.
