Abstract

Musical arts are one of the fields affected by the onslaught of information and technology storms in today's fast-paced era. Because of this onslaught, new forms and things in music are increasingly emerging. One of the things that was born in the art of music in the current era is the activity of covering songs uploaded on TikTok. A song cover is an activity when someone other than the creator or Copyright holder performs another version of a song owned by the creator or Copyright holder. While TikTok is a social network that provides a platform for its users to upload videos. This song cover activity uploaded on TikTok splashes a legal discourse regarding copyright that has the potential to be harmed by the perpetrator and uploader of the cover. On the other hand, in the Copyright discourse there is a doctrine called fair use. Fair use is felt to be a bridge between the creator or copyright holder and the perpetrator and uploader of the song cover in this context. Therefore, this study will discuss song cover activities and how they are related to copyright infringement and how the fair use doctrine is applied to this activity. This research uses doctrinal legal research methods and descriptive types of research. The type of data used in this research is in the form of secondary data collected by the literature study method. Data analysis in this study is qualitative. The author in this study draws the conclusion that the perpetrator and uploader of song covers on TikTok have the potential to violate copyright but can also be justified on the condition that the perpetrator meets the principle of fair use which is applied on the basis of Article 43 letter d of Law Number 28 of 2014.
