Abstract

This study aims to determine the profile of the exonation clause in the standard agreement of PT. Telkom Indonesia Surakarta City, namely in the New Internet Subscription Contract. This study explains that the New Internet Subscription Contract is an agreement called (nominaate) a type of sale and purchase agreement, in which there is a standard agreement and an exoneration clause in the contract. Then describe the rights and obligations of the parties, namely the business actor of PT. Telkom Indonesia and consumers based on the Civil Code, then analyzed whether the clause contained in the New Internet Subscription Contract is an exoneration clause or not. The inclusion of an exoneration clause aims to divert, reduce or eliminate the responsibility of the business actor which is detrimental to consumers. Based on statutory regulations, namely Law no. 8 of 1999 concerning Consumer Protection, business actors are prohibited from including an exoneration clause which states transferring, reducing or eliminating the responsibilities of business actors in every standard document or agreement. Thus, in this study the authors write a problem formulation that is related to how the profile of the exonation clause in the standard clause on the indihome internet subscription contract.
