Abstract

previously been recorded and performed by another musician / artist. many new musicians are trying their luck by bringing cover versions of songs to make them more successful and famous. This study aims to determine the implementation of the practice of covering songs without the author's permission and to find out the protection mechanism for musical art works that are sung again in Youtube Policy in terms of the Copyright Law. This research is a descriptive study and an empirical juridical approach. The results showed that the implementation of the Cover Version of the song by Roni Ramadhan and Allya Rizki Putri had tried to obtain permission but never got a response, so both of them decided to entrust the YouTube system to distribute royalties and fulfill the creator's moral rights by including the work and the author's name. However, some cover versions without permission and obtaining income can violate the economic rights of the creator if the creator feels disadvantaged. in the Youtube copyright protection mechanism, a musician named Fenomenear found the weakness of the Youtube system. The songs that he created by other people were not detected in the Content ID system due to the use of a different arrangement. The solution from Youtube is registering copyright songs and submitting copyright claims using the Youtube form system.
