Abstract

This research is a comparative result in response to the results of the government's decision on Social Insurance Administration Organization (BPJS Kesehatan) with the fatwa of the Indonesian ulema council (MUI) in ijtimak' ulama V in 2015 and the 33rd fatwa jam'iyah nahdhotil ulama (NU) in 2015. The purpose of this study discussed whether BPJS kesehatan was in accordance with Islamic sharia, or there are even points that are contrary to the basic values of Sharia. This research is also as a bridge in revealing the difference arguments from big organizations in Indonesia (MUI & NU) against the application of Social Insurance Administration Organization (BPJS Kesehatan) as a solution to refinement of the public health regulation in Indonesia. This study employed the type of library research in which the researcher studied the primary data sources such as the results of ijtimak ulama to V in 2015, the results of the 33rd NU conference in 2015, constitutions and political decision commited by President related to Social Insurance Administration Organization (BPJS Kesehatan), with the further addition of secondary literacy sources such as books Hadith, fiqh books, scientific journals and books closely related to research materials. This research emerged data to be processed. In addition, the data research obtained through the method washfi tahlili wal muqorin (Descriptive Analytical, and comparative) namely by reading, recording, analyzing. Furthermore the data were then compiled / compared. Thus, the data can be clearly understood, and both methods were used to formulate some solutions of the different argument from many points of view in the study. To conclude, the solution which the researcher offered is to combine the two opinions of fatwa MUI and NU related to Social Insurance Administration Organization (BPJS Kesehatan), in other words it is well known as al-jama' baina qoulain technique. It is the better solution to the problems of Social Insurance Administration Organization (BPJS Kesehatan). Moreover this solution is in the better solutions so that BPJS can be run until waiting for the emergence of the concept of BPJS Health Sharia.
