Abstract

Abstract The goods transportation agreement is a reciprocal punishment between the two parties between JNE EXPRESS and the sender binding himself to carry out the delivery of goods to the destination. After the agreement on the delivery of goods between JNE EXPRESS and the sender, a legal relationship arises between JNE EXPRESS and the sender to exercise their rights and obligations. If in the delivery of goods one of the parties does not fulfill the obligations as agreed upon, it can be accounted for on the basis of Default and if one of the parties does not carry out in accordance with the applicable regulations, he must be responsible based on illegal acts. This study aims to determine the process of carrying out the shipping / shipping agreement between JNE EXPRESS and the sender, rights and obligations as well as regulations stipulated in the freight / shipping agreement, and legal responsibility if one party makes a mistake on the basis of default and / or Unlawful Actions. The method of approach used based on legal research is to use a normative approach that examines the legal aspects, legal rules, legal principles for the implementation of certain time employment agreements. This research is descriptive because in the research it explains thoroughly the rules in the process and the implementation of legal responsibility in the implementation of work agreements / work agreements at a certain time. The results of the study state that the Implementation Process of the Freight / Freight Agreement Between JNE Express and the Shipper, in the process of implementing the freight / shipping agreement, before the agreement between the two parties, both JNE Express and the sender must fulfill administrative requirements and legal requirements; Regulations and the Rights and Obligations Between JNE Express With the Shipper, the regulation between JNE Express and the sender in carrying out the freight / shipping agreement must meet the legal requirements of the agreement in accordance with Article 1320 of the Civil Code; and Legal Responsibility If One of the Parties Mistakes on the basis of Default and Act Against the Law in accordance with Article 1365, Article 1366 of the Civil Code.
