Abstract

Abstract Development in the field of employment, especially for job providers, plays a very important role in national development which functions to realize community welfare in community life for the development of a better standard of living for the community. In its application in the implementation of work in the company carried out by employers / companies with workers / laborers relating to the production of business carried out by employees and employees, in addition to obtaining as much profit as possible also aims to meet the needs of the community. With the holding of this study aims to determine the process of implementing work agreements / Specific Time Work Agreements (PKWT), rights and obligations as well as applicable labor regulations, as well as knowing legal responsibilities if one of the parties makes a mistake in carrying out certain work time. The method of approach used based on legal research is to use a normative approach (doctrinal) that examines legal aspects, legal rules, legal principles towards the implementation of certain time employment agreements. This research is descriptive because in the research it explains thoroughly the rules in the process and the implementation of legal responsibility in the implementation of work agreements / work agreements at a certain time. The results of the study state that in the process and implementation of work agreements / Specific Time Work Agreements must meet the regulations governing them, administrative requirements and legal requirements contained in Article 52 paragraph (1) of Act No. 13 of 2003 concerning Labor. Then an agreement occurs with the signing of a Work Agreement / Specific Time Work Agreement that is made by the employer / company based on the standard agreement. So that the agreement of the parties raises a legal relationship to carry out rights and obligations. The right of workers / laborers is an obligation of employers / companies PT. Prima Sejati Sejahtera. Likewise, the right of employers / companies is an obligation of workers / laborers. If there is one party making a mistake in the work agreement / work agreement at a certain time, then it must be responsible on the basis of default and if it does not carry out the work agreement and does not carry out agreed work agreements or illegal acts that do not comply with the regulations agreed / made, and does not have a good intention in implementing the work agreement at a certain time Keywords: Employees, Employees, Companies, Specific Time Work Agreements, PT.
