Abstract

Land transportation especially Bus has an important role in human activities, ranging from transportation in the city, outside the city, between provinces and there are also those used for tourism transportation. Buses that are used as a means of tourism transportation are usually rented by consumers for special tourism activities. Therefore, this study aims to determine the process of tourism bus rental lease agreements between consumers and DAMRI companies, the applicable regulations, and the rights and obligations of both parties, and their legal responsibilities if one of the parties makes a mistake in renting a tourism bus. This research is descriptive because it will explain about the legal responsibility of the tourism bus leasing agreement. This research approach is normative empirical because it will examine the regulations that are in the process of renting a tourism bus. The results of this study indicate that in the process of renting a tourism bus, consumers must fulfill all regulations and administrative and legal requirements. After this, consumers are required to fill out tourism bus rental forms which must then be signed by consumers and DAMRI companies. When consumers and DAMRI companies sign a formal form of tourism bus rental, it means that there has been an agreement between the two parties. From the agreement, a legal relationship will be created which creates rights and obligations. Consumer rights are an obligation of the DAMRI company, while the rights of DAMRI companies are the obligations of consumers. Then both parties must comply with applicable regulations, because if there will be no legal responsibility. Legal responsibility occurs when one party makes a mistake. Errors can be based on defaults regulated in Article 1243 of the Civil Code and acts against the law regulated in Article 1365 and 1367 of the Civil Code, they must compensate
