Abstract

This study aims to determine the application of the contents of the agreement in which there is an exoneration clause on the Courier Service business in TIKI and the protection of the law against the consumer due to the implementation of the exoneration clause. The research method uses normative juridical approach (doctrinal normative), ie research which refers to existing literature study or secondary data which aims to gain normative knowledge about the relationship between one rule with other regulation and implementation in practice. The type of research is descriptive. Sources of data consists of primary data ie deed of agreement on the delivery of goods by conducting research in Courier Service Company that is TIKI, while secondary data in the form of written documents relating to the object under study is receipt (receipt) payment from courier service company. Methods of data collection through observation, interview and literature study, then the data were analyzed qualitatively. The results showed that the exoneration clauses contained in the standard agreement is an effort to release the responsibility of service business actors to consumers, it happens because the lack of public knowledge about the existence of Consumer Protection Act which resulted in consumers less mengetauhi rights that must be obtained and the responsibility of business actors, ultimately in the dispute resolution effort does not provide a satisfactory meeting point. In the standard agreement in the payment note of TIKI merchandise service contains exoneration clause which is contradictory to Law Number 8 Year 1999 concerning Consumer Protection because of lack of attention to consumer rights in its application.
