Abstract

The purpose of this study is to describe (1) the conformity of the lease agreement with the Decree of the Minister of Finance No. 634 / KMK.013 / 1990 and Number 43 / PMK.010 / 2012 and (2) ideal agreement in accordance with the current condition of society. This research was conducted at Lembaga Pembiayaan Surakarta with research subject: PT. Andalan Finance, PT. Astra Sedaya Finance, and IAF Multifinance in Surakarta. Data collection techniques use observation, interview and documentation. Data analysis techniques using qualitative data analysis techniques. Result of research: (1) Lease agreement made by leasing institution in Surakarta, is lease goods lease agreement by leasee by way of direct finance lease through leasing company for use by leasee for a certain period, which is implementation of Decision Minister of Finance of the Republic of Indonesia Number: 643 / KMK.013 / 1980, concerning Procurement of Capital Goods Facility through Leasing Company (Leasing Company). The ideal form of covenant in accordance with the present conditions of society is the covenant which actually implements the true "contractual freedom principle" in the sense that both parties make the covenant absolutely granted the freedom to make or not to enter into an agreement, enter into an agreement With whomever, determines the contents of the agreement, its execution and its terms and determines its written or oral form of agreement.
