Abstract

Employment conditions are currently faced with various problems that are difficult to resolve, which could potentially create problem in industrial relations, such as termination of employment (PHK) by employers of their workers. In this context, legal regulations are very important to create a balance of social justice between the two parties. This research aims to identify the legal basis for regulating termination of Employment and to evaluate the implementation of legal policies aimed at protecting workers affected by layoffs. The research method used is normative juridical research, which involves analysis and understanding of existing legal regulations in Indonesia. The research showing that the basis for regulating layoffs can be found in Law Number 13 of 2003 concerning Employment, Law Number 2 Of 2004 concerning Settlement of Industrial Relations Disputes, and Law Number 6 of 2003 concerning Establishment of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation Becomes Law. It is hoped that this regulation can become a basis for handling problems that arise in the context of layoffs and industrial relations.
