Abstract

Advances in technology in Indonesia are developing very rapidly from time to time, one of which is in the field of transporting people by land. Transportation of people by land is one of the transportations that is widely used by many people to fulfill activities from moving from one placeto another, from one island to another, therefore the needs of the community are very fulfilled. In the case of transportation of people by land, of course there is an agreement between the carrier and the passenger. This study aims to determine the process of the transportation agreement between the carriers, namely PT. Rosalia Indah with passengers, regulations and rights and obligations of both parties as well as the legal responsibilities of the agreement between the carrier and the passenger. The approach method used in this research is using normative law, while the type of research used is descriptive, namely analyzing and describing in a structured manner related to legal responsibilities between carriers and passengers. The result of this research is that the agreement process for the transportation of people by land consists of three stages, namely before an agreement occurs, when an agreement occurs, and after an agreement occurs. Before an agreement is reached, both parties must meet the registration requirements and legal requirements. When the agreement is made through an agreement marked by the purchase of tickets by passengers and approved by the ticket issuer (counter) which then creates a legal relationship in the form of rights and obligations of the parties. Where the right of the carrier is to receive fees from services from passengers, while the obligation of the carrier is to carry passengers from one place to another safely. The passenger's right is to enjoy the services provided by the carrier, while the passenger's obligation is to pay the transportation fare. In carrying out the rights and obligations of the parties must not violate the applicable regulations. if one of the parties does not carry out its obligations then the party is responsible for the act of default (Article 1243 of the Civil Code) but if one of the parties violates the regulations, the applicable law then the party is responsible for the act against the law (Article 1365 of the Civil Code).
