Abstract
This study aims to examine the considerations of the panel of judges regarding the corruption and money laundering offenses involving PT Timah Tbk, as outlined in rulings No. 70/Pid.sus-TPK/2024/PN.Jkt.Pst and No. 1/Pid.sus-TPK/2025/PT.DKI. Harvey Moeis committed acts of corruption and money laundering within PT Timah Tbk's mining operations. Public reaction suggests the ruling against Harvey Moeis is far from just, given the leniency of the sentence relative to the magnitude of the state financial loss. This study employs a normative-juridical approach and is descriptive in nature, utilizing a literature review method to gather primary, secondary, and tertiary legal materials. Data analysis was conducted qualitatively. The findings indicate that the discrepancy between the court of first instance's ruling and the appellate ruling stemmed from the application of sentencing guidelines specifically Supreme Court Regulation (PERMA) No. 1 of 2020 concerning Sentencing Guidelines for Corruption Offenses under Articles 2 and 3. The difference in the final verdicts also arose because the appellate judges disagreed with the first-instance judges' assessment regarding the calculation of the financial loss. John Rawls's theory of justice posits that justice is grounded, at least in part, in procedural aspects, meaning that the enforcement of legal norms serves as a manifestation of justice.
