Abstract

This study aims to analyze the legal framework of the relocation of the National Capital (IKN) and its implications for the principle of regional autonomy within Indonesia’s constitutional system. The research employs a normative juridical method using statutory, conceptual, and comparative approaches. The findings indicate that the relocation of the capital has a constitutional basis in the 1945 Constitution as an open legal policy under the authority of the central government. Further regulations are stipulated in Law Number 3 of 2022 in conjunction with Law Number 21 of 2023 concerning the National Capital, which designates Nusantara as the new capital and establishes a special institutional model through the IKN Authority. This model reflects a limited form of autonomy that tends to be centralized and is closer to the principle of deconcentration rather than pure decentralization. The implications of the capital relocation include the dominance of central government authority, limited regional public representation, and potential conflicts of authority with surrounding regions. Additionally, fiscal impacts arise in the form of reduced regional financial capacity and increased dependence on the central government, despite the potential for new economic growth. From social and administrative perspectives, the relocation triggers demographic changes, increased demand for public services, and institutional adjustment challenges. Therefore, comprehensive and equitable regulations are required to maintain a balance between national interests and the principle of regional autonomy.
