Abstract

The Village Consultative Body (BPD) is an institution that plays a strategic role in the administration of village government through its legislative functions, the channeling of community aspirations, and the oversight of the village head’s performance, as stipulated in Law No. 6 of 2014 on Villages. Optimizing the implementation of these functions is a key factor in realizing democratic, participatory, and accountable village governance. This study aims to analyze a comparison of the optimization of the Village Consultative Body’s functions in Kenokorejo Village and Tepisari Village, Polokarto Subdistrict, Sukoharjo Regency, as well as to identify the factors hindering the implementation of the BPD’s functions in both villages. This study employs an empirical legal research method with a descriptive-comparative approach. Primary data were obtained through interviews with the BPD chairperson, BPD members, village heads, and relevant parties, while secondary data were obtained through a literature review of laws and regulations, village documents, and relevant literature. The data were analyzed qualitatively by comparing the implementation of BPD functions in both villages based on applicable legal provisions. The research findings indicate that the BPDs in Kenokorejo Village and Tepisari Village have generally performed their functions well. Regarding legislative functions, both BPDs have conducted discussions and reached agreements on draft village regulations with the village heads in accordance with applicable laws and regulations, although Kenokorejo Village has produced a greater number of village legal instruments. Regarding the function of channeling public aspirations, both villages have established mechanisms for gathering community input; however, Tepisari Village has a more structured system through BPD representatives in each sub-district as well as regular forums at the RT and RW levels. In terms of oversight, both BPDs have conducted monitoring and evaluation of the village heads’ performance, with Tepisari Village implementing more intensive oversight through the regular presence of BPD members at the village office. Constraints in Kenokorejo Village include budget limitations, communication among members hindered by their respective busy schedules, and the potential for suboptimal transparency in the oversight process. Meanwhile, in Tepisari Village, these obstacles are relatively minor due to strong institutional communication, although the BPD still faces limited access to some village financial administrative information.
