Abstract
Freedom of expression is a constitutional right that may be exercised through various forms of media, including music as a means of conveying criticism toward the government. The rapid development of digital technology has expanded the dissemination of musical works while simultaneously raising legal concerns regarding the scope of legal protection. This study aims to analyze the construction of Indonesian positive law and the Islamic perspective on freedom of expression in the form of criticism toward the government through music. This research employs a normative juridical method using statutory and conceptual approaches. The study relies on primary, secondary, and tertiary legal materials collected through library research. The collected legal materials are analyzed using a qualitatuve descriptive method, and conclusions are drawn through deductive reasoning. The findings indicate that Indonesian positive law generally protects criticism of the government expressed through music as part of the constitutional right to freedom of expression, provided that such expressiom does not fullfill the elements of criminal offenses stipulated in the prevailing laws and regulations. From the perspective of Islamic law, criticism directed at the government constitutes and implementation of amar ma’ruf nahi munkar, while muisc is regarded as a neutral medium whose legal status depends on its purpose, content and consequences. Therefore, criticism conveyed through music is permissible as long as it is expressed responsibly, promotes public welfare (maslahah), and does not contain defamation, slander, hate, speech, or elements that encourage immoral conduct
