Abstract
Cosmetic industry business licensing is intended to provide legal certainty and protection for consumers. However, according to a BPOM press release dated August, 01 2025, at least 24 cosmetics were found to contain hazardous ingredients. The research aims to determine and analyze business licensing in the cosmetic industry based on regulations in Indonesia, as well as legal sanctions based on Law Number 8 of 1999 concerning consumer protection. The research method used is normative juridical with a statutory approach through library research on the 1945 Constitution, the Health Law, the Consumer Protection Law, Government Regulation No. 28 of 2025 concerning Risk-Based Business Licensing, and various BPOM regulations. The findings indicate that the risk-based licensing system through OSS-RBA, the obligation of a Business Identification Number (NIB), Good Manufacturing Practice certification (CPKB), and marketing authorization in the form of notification have been designed as preventive control instruments to ensure the safety, quality, and benefits of cosmetic products.
