Abstract
This study aims to analyze the implementation of the restorative justice approach in handling minor assault cases at the Kepolisian Resor Kota Surakarta and to identify the challenges and opportunities for its development. The research employs an empirical legal method with a socio-legal approach and is descriptive-qualitative in nature. Primary data were obtained through interviews and direct observation, while secondary data were derived from the Kitab Undang-Undang Hukum Pidana, Peraturan Kepolisian Negara Republik Indonesia Nomor 8 Tahun 2021, and Peraturan Kepala Kepolisian Negara Republik Indonesia Nomor 6 Tahun 2019. The findings indicate that restorative justice has been implemented in accordance with the existing legal framework, particularly for minor assault cases regulated under Article 352 of the Criminal Code. However, its application remains limited, accounting for less than 20% of total cases between 2022 and 2024. Major challenges include victim refusal to settle, potential social conflict, public and media pressure, the absence of detailed internal standard operating procedures, and limited mediation skills among investigators. Nevertheless, significant opportunities exist through regulatory refinement, capacity building for investigators, inter-agency coordination, and improved public legal literacy. Strengthening these aspects may enhance restorative justice as a more humane and socially restorative mechanism in minor assault case resolution.
