Abstract
The practice of buying and selling sea vessels exceeding 7 Gross Tonnage (GT) without authentic deeds remains prevalent among Indonesian fishing communities. This reality raises fundamental juridical questions, as national shipping regulations require notarial deeds as a formal prerequisite for transferring ship ownership. This study aims to analyze two issues: the legal consequences of ship sale and purchase agreements above 7 GT made without authentic deeds, and the evidentiary strength of the documents used in such transactions. The method employed is normative juridical, using secondary data comprising primary and secondary legal materials gathered through literature studies and analyzed qualitatively and descriptively. The findings reveal two distinct dimensions. First, based on Articles 1320, 1338, 1457, and 1874 of the Civil Code and Articles 1(2), 1(3), 4, and 7 of Law No. 8 of 1999 on Consumer Protection, the agreement is materially valid and legally binding on both parties. Second, formally and juridically, pursuant to Articles 309 and 314 of the Commercial Code, Article 158 of Law No. 17 of 2008 on Shipping, Article 30 of Government Regulation No. 51 of 2002 on Shipping, Article 7(3)(e) of Ministerial Regulation No. 39 of 2017, and Articles 1(7) and 15(1) of Law No. 2 of 2014 on Notarial Duties, ship ownership has not legally transferred from the seller to the buyer. A receipt as the sole transaction document carries binding evidentiary force only insofar as both parties acknowledge its truth, but it does not possess the perfect evidentiary power of an authentic deed. This study affirms that legal certainty in ship ownership transfers can only be achieved through a notarial deed followed by formal re-registration with the authorized ship registration officer.
