Abstract

Citizen journalism refers to journalistic activities carried out by members of the general public who are not professional journalists in the mass media. Its emergence is closely tied to advancements in information technology, as well as public dissatisfaction and a decline in trust in conventional media, which are often perceived as aligned with specific political or economic interests. Furthermore, citizen journalism has become a manifestation of freedom of expression in the digital sphere, although in practice it frequently faces criminalization or repressive actions from other parties. Nevertheless, to date, there are no legal regulations that explicitly and unequivocally provide protection for the practice of citizen journalism. This study employs a normative legal methodology with a literature review approach. The objective of this research is to analyze the legal framework and forms of protection for citizen journalism from the perspective of positive law, and to examine these through the lens of Critical Legal Studies (CLS). The analytical method used is descriptive, utilizing secondary data sources, as well as primary, secondary, and tertiary legal materials. The results of the study indicate that the regulations and protections for citizen journalism practices remain general in nature and can only be derived from the constitutional guarantees of citizens’ rights. This situation has the potential to impose restrictions on the public’s freedom of expression and reflects a lack of responsiveness
