Abstract

This study aims to determine and analyze the role of the Sukoharjo Police Resort in handling traffic accident cases involving children, as well as to identify the obstacles and efforts made in resolving such cases. This issue is motivated by the increasing involvement of children in traffic accidents, both as perpetrators and victims, which reflects low legal awareness and insufficient supervision from families and the surrounding environment. On the other hand, children as legal subjects have a special status that requires protection within the juvenile criminal justice system. This study employs an empirical juridical approach with descriptive specifications. Data were obtained through literature review and field research in the form of interviews with the Sukoharjo Police Resort, and were analyzed qualitatively. The results indicate that in handling traffic accident cases involving children, the Sukoharjo Police prioritize a restorative justice approach through diversion mechanisms. This approach aims to prevent children from undergoing formal judicial processes and to protect their psychological development. The implementation of diversion considers the best interests of the child, the level of culpability, and the resulting impacts. However, several obstacles remain, including a lack of understanding among the parties regarding diversion mechanisms, differing perspectives between victims and perpetrators, and limited resources. Therefore, it is necessary to enhance public awareness, strengthen inter-agency coordination, and improve the capacity of law enforcement officers to ensure fair law enforcement while safeguarding children's rights.
