Abstract

This research examines the legal standing of a witness who is an atheist in court. According to the Law of the Republic of Indonesia Number 20 of 2025 concerning the Code of Criminal Procedure, it is explained that before a witness provides testimony, the judge takes an oath or affirmation from the witness or expert based on their religion. Considering that there are still various other beliefs held by some members of society, including belief systems and several atheist communities that choose not to believe in the concept of divinity, the use of religious oaths in the judicial realm creates bias in the law enforcement process, particularly regarding the neutrality and objectivity of the law. Using a critical-philosophical approach, this qualitative research analyzes the legal position normatively and philosophically, drawing from statutes and other relevant literature. As a result, this study reveals that evidence from unsworn witness testimony lacks probative value and is not considered valid evidence in criminal case proceedings as stipulated in Article 211 of the Code of Criminal Procedure. From the perspective of deconstruction theory, witnesses with religious status who are sworn or affirmed before providing testimony before the panel of judges have privileges compared to non-religious witnesses or atheists. Following up on this research, the researcher recommends the formation of an egalitarian, rational, objective, neutral Code of Criminal Procedure that upholds non-discrimination values. Furthermore, to ensure that all testimony provided by witnesses can be scientifically accountable, the researcher highlights the importance of the role of linguists in the evidentiary process in criminal justice to analyze the meaning and context of witness statements academically. The presence of linguists can support the court in understanding language construction, the intent of statements, and the integrity and consistency of the narrative presented by witnesses objectively and based on scientific study.
