Abstract

This study aims to determine the Judge's Considerations in deciding cases of motorcycle theft committed by children and to find out how judges interpret and assess the elements of disturbing the community in cases of aggravated motorcycle theft committed by children. This study is based on the increasing number of motorcycle theft crimes involving children as perpetrators, so that it is necessary to handle it by prioritizing the principles of protection and the best interests of children as regulated in Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. The formulation of the research problem includes: (1) How are the Judge's Considerations in deciding cases of motorcycle community in cases of aggravated theft. This study uses the Juridical-Nomative method with a statutory approach and a case approach. The results of the study show that judges not only consider the Juridical elements but also use the Non-juridical elements of Children, while the assessment and interpretation of disturbing the community is carried out by judges subjectively
