Abstract
The implementation of a policy requiring the use of a Population Identification Number (NIK) as a requirement for purchasing subsidized 3 kg LPG is part of the government's strategy to ensure that subsidy distribution is carried out effectively. However, this policy also has legal implications, particularly those related to the protection of consumers' personal data. This research focuses on assessing the compliance of the NIK submission requirement, including the data processing and storage mechanisms carried out by LPG depots, with applicable legal provisions. In its implementation, this research relies on a theoretical framework that includes the concepts of personal data protection and the right to privacy, with reference to Law Number 27 of 2022 concerning Personal Data Protection and Law Number 8 of 1999 concerning Consumer Protection. The method used is normative juridical research with a descriptive-analytical approach. Research data were collected through literature review, which was then strengthened by primary data in the form of observations and interviews at LPG depots. The results of the study indicate that the NIK submission requirement for purchasing subsidized LPG is essentially in accordance with personal data protection provisions because it is carried out for legitimate purposes, namely verifying subsidy recipients, and is based on consumer consent. In addition, the mechanism for processing and storing personal data by LPG Sub-Distributors has generally been implemented through Pertamina's Merchant Apps digital system and is only used for subsidy data collection purposes, so that it can be legally accounted for.
