Abstract
Sexual violence remains a persistent issue, including cases committed by medical personnel. This study aims to identify the forms of legal accountability that can be imposed on medical personnel who disclose sexual information, according to criminal law and professional ethics law, as well as the roles of health care institutions and professional organisations in preventing and addressing such disclosures. The study uses a normative juridical research method, employing a statutory approach to examine laws and regulations relevant to these legal issues. The results indicate that legal responsibility is divided into two categories: criminal and administrative. Criminal responsibility is based on the Criminal Code and the TPKS Law, while administrative responsibility involves the revocation of the Registration Certificate (STR) and Practice Licence (SIP). The findings show that members of professional bodies and health care institutions play a significant role. The Medical Ethics Honorary Council(MKEK), as part of the professional organisational structure of the Indonesian Doctors Association (IDI), plays a crucial role in determining whether a case constitutes a violation of professional ethics or the law. Meanwhile, the Indonesian Medical Disciplinary Honorary Council (MKDKI) is responsible for enforcing discipline related to medical professional ethics. The MKEK has the authority to investigate alleged ethical violations by physicians, including sexual acts committed against patients.
