Abstract

This study examines the juridical analysis of retail trading of subsidized Fuel Oil (BBM) without business permits based on Indonesian positive law, particularly Law No. 22 of 2001 on Oil and Gas, and Islamic law. Employing a normative juridical approach with secondary data via library research, the findings indicate that such practices violate downstream oil and gas business licensing regulations and may incur criminal sanctions under Articles 53 and 55 of the Oil and Gas Law, as they deviate from targeted subsidy objectives. From an Islamic law perspective, while the elements of sale contract are fulfilled, it is fasid due to conflicts with public benefit principles (maslahah mursalah), obedience to authority (ulil amri), and prohibition of public asset misuse (ghulul), as per QS An-Nisa/59 and fiqh maxims. In conclusion, the practice is illegal under positive law and unjustifiable in Islamic law, necessitating strengthened oversight and alternatives like Pertashop.
