Abstract

The Free Nutritious Meal Program (MBG) is a strategic policy of the Government of Indonesia to ensure children’s right to safe and nutritious food. However, several cases of food poisoning in its implementation have caused serious health problems among students, raising legal concerns regarding supervision, food safety standards, and the accountability of the Government and the Nutritional Fulfillment Service Unit (SPPG). This study examines accountability of the Government and SPPG in food poisoning cases under the MBG Program and analyzes the legal remedies available to victims. It employs a normative legal method with a juridical-normative approach based on library research of relevant laws and regulations, including the Food Law, Health Law, Indonesian Criminal Code (KUHP), Presidential Regulation No. 115 of 2025, and the Decree of the Head of the National Nutrition Agency No. 401.1 of 2025. The data are analyzed qualitatively using a descriptive-analytical method. The findings show that accountability is shared between the Government, through the National Nutrition Agency responsible for supervision, operational standards, administrative sanctions, and victim recovery and the SPPG, which bears operational responsibility and may incur criminal liability if negligence results in serious harm. Legal remedies may proceed from medical and administrative measures to criminal prosecution where negligence is established. Thus, food poisoning cases under the MBG Program may entail criminal liability and require strengthened oversight and comprehensive victim protection.
