Abstract
Indonesian labor recruitment practices still require female applicants to be unmarried and not pregnant. These provisions have the potential to perpetuate unequal treatment based on gender. While the principles of equality and the prohibition of discrimination have been affirmed in national labor regulations and various international human rights instruments, these requirements contradict applicable legal guarantees. This study examines the alignment of the practice of including clauses prohibiting marriage and pregnancy with international human rights principles and the CEDAW. Furthermore, the analysis also aims to assess the consistency of these provisions with Indonesian positive legal standards. The approach used is a normative juridical approach, examining relevant laws and legal concepts through Law Number 13 of 2003 and Article 11 of CEDAW. Data sources, including primary and secondary legal materials, were analyzed qualitatively to obtain systematic arguments regarding the issues studied. The results of the study indicate that restrictions on women's rights to marry and become pregnant in employment relationships constitute a form of gender-based discrimination. This provision is inconsistent with national labor regulations and laws guaranteeing the protection of human rights, and contradicts international commitments binding Indonesia through the ratification process in Law Number 7 of 1948. From a contract law perspective, the clause also does not meet the requirements for a valid agreement, particularly regarding the existence of a legally permissible cause, so it has no binding force. Therefore, it is necessary to strengthen the monitoring and enforcement mechanisms to ensure the fulfillment of the principle of equality and the protection of the rights of women workers.
