Abstract

The rapid development of Artificial Intelligence (AI) has brought significant transformations to social life and legal systems in the digital era. One of the most controversial applications of AI is deepfake technology, which enables the manipulation of images, videos, and audio to appear highly realistic through machine learning and deep learning techniques. Although deepfake technology offers positive contributions in fields such as entertainment, education, and creative industries, its misuse has emerged as a serious threat in the form of defamation, digital fraud, disinformation, non-consensual pornography, and violations of human rights. This study aims to analyze the various forms of deepfake misuse in digital crimes and to examine their legal, social, and psychological implications within the Indonesian legal context. This research employs a normative legal research method using a statutory approach and a case approach. Data were collected through library research by examining relevant legislation, legal doctrines, court decisions, and scholarly literature related to cyber law and artificial intelligence. The findings indicate that although Indonesia has several legal instruments, such as the Law on Electronic Information and Transactions, the Criminal Code, and the Pornography Law, these regulations remain fragmented and do not explicitly address deepfake technology. This regulatory gap creates legal uncertainty, complicates evidentiary processes, and weakens legal protection for victims. Furthermore, the social and psychological impacts experienced by victims, including social stigma, trauma, and loss of self-confidence, demonstrate that deepfake-related crimes extend beyond legal violations to fundamental threats against human dignity. Therefore, this study highlights the urgent need for the establishment of adaptive and comprehensive regulations specifically addressing deepfake misuse, the strengthening of digital literacy, and the adoption of a progressive and ethical legal approach to ensure that the development and use of AI technologies align with the principles of justice, human rights protection, and social welfare.
