Abstract
The development of financial technology has driven the increasing use of digital wallets as a means of payment, but on the other hand, it also poses risks, including balance loss due to system failures, hacking, and social engineering practices. This research is a normative legal study using statutory, conceptual, and prophetic approaches. The data sources used include primary legal materials such as the Electronic Information and Transactions Law (UU ITE), the Consumer Protection Law, Bank Indonesia Regulations on Electronic Money, Financial Services Authority Regulations, as well as DSN-MUI Fatwas and the Compilation of Sharia Economic Law (KHES). The data were analyzed qualitatively and descriptively by comparing positive legal provisions with Islamic legal principles. The results of this study indicate that, under positive law, protection for e-wallet users has been regulated through various regulations that require electronic system providers to guarantee security and be responsible for user losses. However, in practice, the implementation of this protection has not been fully effective. From an Islamic legal perspective, protecting e-wallet balances falls under the principle of hifz'al-mal (protection of assets) and is based on the principles of trustworthiness, justice, and the Islamic jurisprudence of la darar wa la dirar. Therefore, service providers have a legal and moral responsibility to safeguard and compensate users in the event of negligence.
