Abstract

This research analyzes the role and legal position of witnesses during the reading of notarial deeds based on the formal requirements stipulated in Law Number 2 of 2014 on the Office of the Notary. The study focuses on the essential function of witnesses in ensuring the validity of deeds and examines their relationship with the principle of legal certainty in the formation of authentic deeds. This research employs a normative legal method using statutory and literature approaches. The data are obtained from legal instruments, notarial scholarly works, and relevant academic publications, which are processed through qualitative descriptive analysis to interpret the normative provisions governing witnesses in notarial practice. The findings indicate that witnesses serve a formal evidentiary function that determines the authenticity of notarial deeds. The presence of witnesses reinforces legal protection for the parties and ensures the fulfillment of the formal requirements of authentic deeds. The study concludes that the absence of witnesses reduces the evidentiary strength of deeds, rendering them equivalent to private deeds, while their presence is essential to maintaining the integrity of the notarial profession and promoting legal certainty for society.
