Abstract

This study examines Dynamic corporate criminal liability for batik industry wastewater pollution in the City of Surakarta by assessing the effectiveness of Law Number 32 of 2009 on Environmental Protection and Management following its amendment through Law Number 6 of 2023 on Job Creation. The analysis focuses on the shift in the strict liability principle, the implementation of risk based business licensing, and their implications for environmental criminal law enforcement against corporations. This research employs a qualitative legal method with an empirical approach, using interviews and literature review. The findings indicate that although the normative framework for corporate criminal liability remains in place, the enforcement of environmental criminal law against batik wastewater pollution in Surakarta has not been effective. This is due to weak supervision, the dominance of administrative sanctions, and the reduced application of strict liability after the enactment of the Job Creation Law. The study highlights the gap between legal norms and enforcement practices and provides a basis for strengthening corporate criminal liability in the batik industry sector.
