Abstract
Land ownership is a crucial component of the land development process carried out by companies, particularly in the property and infrastructure sectors, to ensure legal certainty in land development in accordance with Ministerial Regulation Number 18 of 2021 and Ministerial Regulation Number 5 of 2025. However, in practice, land ownership by companies must go through a transfer of rights to building use rights because it has a relatively long time period. This study aims to examine the legal provisions governing land ownership by corporate legal entities and knowing the procedures for transferring ownweship rights to a legal entity. This research applies a normative legal method focused on statutory and regulatory analysis. The results of the study indicate that: (1) land ownership by corporate legal entities originating from land with Ownership Rights must be converted into land with Building Use Rights, provided that the requirements are fulfilled, namely: the entity is a legal body, established under Indonesian law, and domiciled in Indonesia; and (2) the procedure for transferring ownership rights over land with Ownership Rights to a corporate legal entity consists of four stages, namely: submission of an application for rights, acceptance of documents and land parcel measurement, determination of rights, and ratification and signing of the final documents.
