Abstract
This study aims to determine the legal protection for victims of same-sex sexual harassment crimes based on the perspective of positive law in Indonesia and Islamic law. The background of this study is based on the increasing cases of sexual violence that now also target the same sex (homosexuals), which are often not specifically accommodated in old regulations, resulting in a gap in protection for victims. The research method used is normative juridical with a statutory approach, descriptive in nature, and using qualitative data analysis techniques through literature studies. The discussion shows that in positive law, victim protection is regulated through Law No. 1 of 2023 (New Criminal Code) Article 414 which expands the scope of indecent acts, as well as Law No. 31 of 2014 and Law No. 12 of 2022 (TPKS Law) which guarantees victims' rights to medical assistance, psychosocial rehabilitation, and protection from intimidation through LPSK. Meanwhile, under Islamic law, homosexual acts (liwath) are categorized as a major sin and forbidden. Victim protection is achieved through the imposition of ta'zir sanctions on perpetrators and a humanistic approach to preaching to restore human nature. In conclusion, both positive law and Islamic law place serious emphasis on protecting victims of same-sex sexual harassment to ensure a sense of security and the fulfillment of their rights as part of human dignity.
