Abstract
This study aims to analyze the application of criminal sanctions against children as perpetrators of physical violence whose victims are also children, as reflected in Decision No. 23/Pid.Sus-Anak/2023/PN Surabaya, and to examine the conformity of the verdict with the principles stipulated in Law No. 11 of 2012 concerning the Juvenile Criminal Justice System (SPPA) and the perspective of Islamic law. The main issues discussed in this research are the form of criminal liability of children in cases of physical violence among minors and the application of criminal sanctions by the court in the decision. This research employs a normative juridical method with a case approach and statutory approach. The data sources consist of primary legal materials such as laws and court decisions, secondary legal materials including literature, journals, and expert opinions, and tertiary legal materials such as legal dictionaries and encyclopedias. The data were analyzed using qualitative descriptive analysis to evaluate the conformity of the court’s ruling with the principles of restorative justice and child protection. The results indicate that the imposition of criminal sanctions on the child perpetrator of physical violence in Decision No. 23/Pid.Sus-Anak/2023/PN SBY has complied with the provisions of the SPPA Law by imposing an eight-month rehabilitation sentence at the Special Child Development Institution (LPKA). The judges considered mitigating factors such as the offender’s young age, remorse, and family background, as well as aggravating factors including the harm to the victim and public unrest. From the perspective of Islamic law, the sanction aligns with the concept of ta’zīr, which emphasizes education and moral improvement rather than punishment. Therefore, this decision reflects the implementation of the restorative justice principle, focusing on rehabilitation and reformation of the child offender instead of punitive measures.
