Abstract

Cases of child molestation in Indonesia continue to increase and become more concerning each year, especially when children become perpetrators of such crimes. This study aims to analyze the legal framework under Law No. 35 of 2014, Law No. 11 of 2012, and Islamic Law, as well as to examine the judge’s considerations and criminal sanctions in Decision Number: 15/Pid.Sus-Anak/2023/PN Yyk regarding a child molestation case involving both a child perpetrator and victim. The research uses a normative juridical approach with qualitative-descriptive data analysis, and secondary data obtained from court decisions. The results show that Law No. 35 of 2014, Law No. 11 of 2012, and Islamic Law regulate child protection and emphasize a rehabilitative rather than retributive approach for child offenders. In the decision, the child perpetrator was found guilty under Article 82 paragraph (1) in conjunction with Article 76E of Law No. 17 of 2016 and was sentenced to five months of rehabilitation at a Youth Protection and Social Rehabilitation Center (BPRSR) and five months of vocational training. This ruling is considered appropriate as it prioritizes the best interests of the child. It is recommended that the Ministry of Education enhance school-based education and community outreach on child protection to prevent children's involvement in criminal acts, both as victims and perpetrators.
