Abstract
Partnerships between tobacco farmers and agribusiness companies are a form of strategic collaboration to increase the productivity, welfare, and competitiveness of tobacco farming in Indonesia. This study aims to examine the validity and dispute resolution of the partnership agreement between Trucuk tobacco farmers and PT. Alliance One Indonesia. The method used is a normative-empirical approach, combining a legal approach based on statutory regulations and field studies through interviews. The results indicate that the partnership agreement meets the legal requirements stipulated in Article 1320 of the Civil Code, namely the existence of an agreement, legal capacity, a specific object, and a lawful cause. Furthermore, the agreement aligns with the principles of partnership stipulated in Minister of Agriculture Regulation No. 18 of 2018, which emphasizes the principles of justice, transparency, and mutual benefit. However, in practice, the implementation of the agreement still faces obstacles, including unequal bargaining power, unilateral price changes, and default by both parties. Dispute resolution is more often conducted through non-litigation channels such as deliberation and mediation involving village officials, while arbitration is a last resort. This research emphasizes the importance of formally and substantively valid agreements, drafted fairly, and not disadvantageous to the party with the weaker bargaining position.
