Abstract
The crime of aggravated theft committed by a child is the act of taking another person's property illegally by an individual under the age of 18, with certain aggravating elements or methods. The objectives of this study are: 1) to examine the criminal regulations for the crime of aggravated theft committed by children based on the provisions of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System and Islamic criminal law, 2) to analyze the basis for judges' considerations in sentencing children as perpetrators of criminal acts. This research is a normative juridical study that uses a statutory approach and case studies. The legal sources used include materials in the form of Court Decision Number 1/Pid.Sus-Anak/2023/PN.Krg and legislation. The results of the study show that first, these two legal systems have similarities in providing special treatment to children who commit the crime of aggravated theft, with an emphasis on rehabilitation, guidance, and protection of children's rights, and making punishment a just and proportional last resort. Second, the basis for the judge's considerations in issuing a verdict in Case Number: 1/Pid.Sus-Anak/2023/PN.Krg, which involved a child perpetrator, includes legal and non-legal considerations, as well as aggravating and mitigating factors.
