Abstract
The circulation of cigarettes that can be accessed by minors has become a concerning issue, particularly in the Sukoharjo Regency area. Although regulations prohibiting the sale of cigarettes to children already exist, field observations show that they are still able to purchase cigarettes easily. This situation has a negative impact on children's health, physical and mental development, as well as their future prospects. This study aims to: 1) To determine efforts to overcome access to cigarette sales to minors in Sukoharjo Regency, 2) Determine obstruction to efforts by overcome access of cigarette sales to minors in Sukoharjo Regency, 3) Determine efforts by overcome access of cigarette sales reviewed from Islamic law. This study employs an empirical juridical approach, which is a legal research method that examines the application of law within society by observing empirical facts in the field. Data collection was conducted through in-depth interviews with relevant agencies, cigarette sellers, and minors as research subjects. The findings indicate that efforts to curb the circulation of cigarettes among minors in Sukoharjo Regency such as awareness campaigns conducted by the Community Development Unit (BINMAS) and the Health Office remain ineffective. Although several regulations exist to restrict the sale of cigarettes to minors, incidents of cigarette sales to children still occur. Contributing factors include: 1) the absence of clear regulations, which prevents law enforcement from having a strong legal basis for taking action, 2) The lack of synchronization of authority between institutions in regulation and supervision, 3) There is no firm law enforcement, 4) The rise of cigarette advertising and promotion, which increasingly encourages children to try cigarettes, 5) Low legal literacy of sellers, especially regarding sanctions for violating the prohibition on selling cigarettes to children, and 6) Minimal supervision by families and schools, which makes it easy for children to access cigarettes. From an Islamic legal perspective, smoking is considered haram because it is harmful to the soul and mind, and is contrary to the principle of maqāṣid al-syarī‘ah to maintain health. This is also emphasized by the Fatwa of the Muhammadiyah Tarjih and Tajdid Council No. 6/SM/MTT/III/2010, which states that smoking is haram, especially for children and in public places, and emphasizes the importance of prohibiting the sale of cigarettes to children as an effort to protect the younger generation.
