Abstract
This study examines the implementation of diversion in resolving juvenile criminal cases in Indonesia through the lens of maqashid syariah. Diversion, as an alternative to formal judicial proceedings, aims to protect children from the negative impacts of the conventional criminal justice system. Within the framework of maqashid syariah, diversion is highly relevant because it promotes the preservation of life (hifz al-nafs), intellect (hifz al-‘aql), and lineage (hifz al-nasl). This research uses a normative legal approach by analyzing statutory regulations, legal doctrines, and court decisions. The findings indicate that the diversion process applied in Case Number 2/Pid.Sus-Anak/2022/PN Pwd was successfully implemented by prioritizing restorative justice, and it reflects the values of maqashid syariah. Diversion not only delivers legal justice but also ensures comprehensive social recovery and child protection. To optimize the implementation of diversion, strong commitment from law enforcement, as well as the support of communities and social institutions, is essential.
