Abstract

The increasing number of transactions within Indonesia's digital economy ecosystem has driven rapid growth in e-commerce. However, this growth also raises the risk of misuse of consumers’ personal data, highlighting the need for strong legal protection as stipulated in Law Number 27 of 2022 concerning Personal Data Protection. This study aims to analyze the provisions related to personal data protection in electronic commerce, both before and after the enactment of Law Number 27 of 2022. The research employs a normative legal method using a legislative and conceptual approach by reviewing various regulations, legal doctrines, and literature relevant to personal data protection. These sources are then analyzed systematically and descriptively to evaluate the implementation of the law in electronic transactions. Prior to the enactment of Law Number 27 of 2022, the protection of personal data in Indonesia’s electronic commerce sector was scattered across various sectoral regulations, offering limited and inconsistent safeguards for consumers. With the introduction of this law, the legal framework has become more systematic and robust. Nevertheless, significant implementation challenges remain, particularly regarding the preparedness of electronic system operators and the effectiveness of regulatory oversight.
