Abstract
Digital trust in online transactions, especially on the Facebook marketplace, has great potential in Indonesia. Despite regulations to protect consumers, fraud cases on this platform continue to rise, resulting in financial losses for users. There are criminals ostensibly selling on Facebook, who take advantage of system weaknesses to commit fraud. This phenomenon not only harms consumers, but can also damage the platform's reputation and hinder the growth of the digital economy in Indonesia. This research aims to analyze the legal protection for consumers in transactions on the Facebook marketplace and identify the responsibilities of criminals who are motivated to sell on the Facebook marketplace. The research method used is juridical-normative with a statutory approach (The Statue Approach) as well as secondary data from literature reviews, including laws and other legal sources. This research analyzes three cases of fraud that occurred in the Facebook marketplace, involving perpetrators with different modus operandi, ranging from the sale of counterfeit goods to organized fraud syndicates. The results show that legal protection for consumers in the Facebook marketplace is still not optimal, with several violations of consumer rights. An inefficient complaint system and lack of account mechanisms exacerbate this situation. The liability of criminal offenders is regulated under the ITE Law, and the Criminal Code, where they can be subject to severe criminal sanctions, including imprisonment and significant fines. In addition, the perpetrator also has the responsibility to compensate the victim for the loss caused. This study concludes that to create a safer online transaction environment, Facebook needs to make improvements in its security and consumer protection systems, as well as stricter law enforcement against fraudsters. In addition, educating users about the risks and how to protect themselves when transacting is also very important to reduce the number of frauds on this platform.
