Abstract

Traffic accidents involving minors pose new challenges in the application of the law, especially regarding the determination of responsibility and sanctions that must be received by the child. Handling this case requires the right approach so that justice and recovery can be achieved for all parties involved. One approach that can be applied is restorative justice. This study aims to analyze the application of restorative justice in resolving traffic accident cases involving children at the Surakarta Police. The method used in this study is an empirical legal approach, with data obtained from field research through interviews and literature studies. The results of the study indicate that the resolution of traffic accident cases involving children as perpetrators is based on Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, which emphasizes Diversion as a form of implementation of restorative justice. In addition, from an Islamic legal perspective, restorative justice is in line with the concept of peace known as Ishlah or As-Sulhu.
